This End-User License Agreement ("Agreement") is a legally binding contract between you ("User," "you," or "your") and SeeMyClouds, Inc. ("Company," "we," "us," or "our") governing your access to and use of the SeeMyClouds mobile application ("App"). By downloading, installing, accessing, or using the App, you agree to be bound by the terms and conditions of this Agreement. If you do not agree to these terms, you must not download, install, or use the App.
Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to use the App solely for personal, non-commercial purposes on a device that you own or control.
Access to certain features of the App requires an active subscription to the SeeMyClouds App, available through the Apple App Store or Google Play Store. We offer the following subscription plans:
We provide a one (1) month free trial for new subscribers. Upon expiration of the trial period, your subscription will automatically renew at the selected plan rate unless canceled through the applicable store (Apple App Store or Google Play Store).
Subscriptions are managed and processed through the Apple App Store or Google Play Store, depending on your device. Subscription fees are charged in advance on a recurring basis (monthly or yearly, depending on the plan) to the payment method registered with the respective store. All fees are non-refundable, except as provided by the store’s refund policies or applicable law.
You may cancel your subscription at any time through the Apple App Store or Google Play Store account settings, as applicable. Cancellation will take effect at the end of the current billing cycle, and you will retain access to subscription features until that time. We do not manage cancellations directly; you must follow the cancellation procedures of the respective store.
We reserve the right to modify subscription fees at any time, subject to the policies of the Apple App Store or Google Play Store. Any fee changes will be communicated through the respective store, and continued use of the App after such changes constitutes your acceptance of the new fees.

The App, including all software, content, updates, enhancements, and modifications, is owned by SeeMyClouds, Inc. or its licensors and is protected by copyright, trademark, and other intellectual property laws. This Agreement does not transfer any ownership rights to you. All rights not expressly granted herein are reserved by us.
We may provide updates, patches, or enhancements to the App, which may be automatically downloaded and installed on your device through the Apple App Store or Google Play Store. You consent to such automatic updates. We may also modify or discontinue the App or any of its features at our discretion without prior notice.
This Agreement is effective until terminated. We may terminate this Agreement and your access to the App immediately if you breach any of its terms. You may terminate this Agreement by uninstalling the App and ceasing all use. Upon termination, you must delete all copies of the App from your devices. Sections 3, 4, 6, 7, 8, and 10 shall survive termination.
The App is provided "as is" and "as available," without warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the App will be uninterrupted, error-free, secure, or free from viruses or other harmful components.
To the maximum extent permitted by applicable law, SeeMyClouds, Inc., its affiliates, officers, directors, employees, or agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, arising out of or in connection with your use of or inability to use the App, even if advised of the possibility of such damages.
This Agreement shall be governed by and construed in accordance with the laws of United States, without regard to its conflict of law principles. Any disputes arising under or in connection with this Agreement shall be resolved exclusively in the state or federal courts located, and you consent to the jurisdiction of such courts.

11.1 Entire Agreement. This Agreement constitutes the entire agreement between you and SeeMyClouds, Inc. regarding the App and supersedes all prior agreements or understandings.
11.2 Amendments. We may amend this Agreement at any time by posting the revised terms within the App or on our website. Continued use of the App after such changes constitutes your acceptance of the revised Agreement.
11.3 Severability. If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
11.4 Assignment. You may not assign or transfer this Agreement or any rights hereunder without our prior written consent. We may assign this Agreement without restriction.
